FlexTide Terms and Conditions

1. Research Use Only / No Human or Animal Use
Products sold by FlexTide are supplied for laboratory research use only. Products are not medications, dietary supplements, cosmetics, food products, or consumer health products. Products are not intended for human or animal consumption, administration, injection, diagnostic use, therapeutic use, or personal use. Nothing in these Terms or on this website should be construed as authorization, endorsement, or approval of any non-research use.
2. Acceptance of Terms
By accessing this website, browsing its content, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms") in their entirety. If you do not agree to these Terms, you may not use this website or purchase any products.
These Terms constitute a legally binding agreement between you and FlexTide. FlexTide reserves the right to update or modify these Terms at any time by posting a revised version to this website. The revised Terms will be effective immediately upon posting. Your continued use of this website or placement of any order after such posting constitutes your acceptance of the updated Terms.
3. Customer Eligibility / Buyer Representation
By placing an order, you represent, warrant, and affirm each of the following:
You are at least 21 years of age;
You are a qualified researcher, scientist, or institution purchasing products solely for lawful laboratory research purposes;
You understand that the products are not intended for human or animal use;
You will not use, resell, distribute, or otherwise make available any product for any prohibited purpose;
All information you provide to FlexTide is accurate, current, and complete; and
Your purchase and use of the products is lawful in the jurisdiction in which you are located.
To complete an order, you must actively confirm your agreement to these Terms through a checkbox or other affirmative click-through mechanism at checkout. Passive awareness of these Terms (such as their presence in a website footer alone) does not constitute acceptance.
4. No Medical Advice / Educational Content
Content on this website, including but not limited to product descriptions, blog posts, educational articles, and any other materials, is provided for general informational and educational purposes only. Nothing on this website should be interpreted as medical advice, treatment guidance, dosing instruction, diagnostic information, or a recommendation for human or animal use. FlexTide is not a licensed medical provider, and no content on this website creates a physician-patient or researcher-subject relationship of any kind.
5. Order Review and Right to Refuse Service
FlexTide reserves the right to refuse, cancel, or limit any order at our sole and absolute discretion, including but not limited to orders that:
Appear inconsistent with legitimate research-use-only purposes;
Include suspicious, inaccurate, or incomplete information;
Raise legal, regulatory, payment, safety, or compliance concerns; or
Otherwise violate these Terms or applicable law.
FlexTide is under no obligation to provide a reason for refusing or canceling an order.
6. Payment Terms
Submitting an order request does not constitute a confirmed, paid, accepted, or approved order. Orders are not processed, packed, or shipped until payment has been received and verified by FlexTide.
Payment must be made through an approved method as communicated to you at checkout or via follow-up correspondence. Payment instructions may be sent separately after an order request is submitted. Failure to complete payment within the timeframe specified in those instructions may result in cancellation of the order request without further notice.
FlexTide reserves the right to modify accepted payment methods at any time. Any payment method not expressly approved by FlexTide in writing is not authorized, and FlexTide bears no responsibility for payments submitted through unauthorized channels.
7. Shipping Policy and Delays
Orders generally ship within 3 business days after payment has been verified (kits ship within 5-10 business days), excluding weekends, federal holidays, weather delays, carrier delays, or order-review holds. FlexTide will make reasonable efforts to communicate material shipping delays but does not guarantee specific delivery dates or windows.
FlexTide is not responsible for:
Carrier delays, disruptions, or failures;
Incorrect or incomplete shipping addresses provided by the customer;
Failed or missed delivery attempts;
Package theft following delivery confirmation;
Delays caused by weather, acts of nature, customs processing, or any other circumstances outside our reasonable control.
Risk of loss and title for products pass to the customer upon FlexTide's delivery of the package to the carrier.
8. Temperature Tolerance and Product Handling
FlexTide's peptide products are supplied in lyophilized (freeze-dried) form. Lyophilized peptides have been shown to tolerate short-term exposure to elevated temperatures, including ambient conditions of approximately 40–45°C / 104–113°F. Because moisture is largely absent in the freeze-dried state, brief warmth during standard transit conditions is not expected to cause material degradation to the peptide structure.
FlexTide does not guarantee continuous refrigerated conditions during transit unless expressly stated in writing for a specific product or order. Transit temperature exposure within the range described above and under typical domestic shipping timelines is considered within acceptable parameters for lyophilized research peptides.
Customer Responsibility After Delivery
Once your order arrives, you are responsible for promptly retrieving the package and storing vials properly to maintain long-term stability. Specifically:
Store vials in a cool, dry location, away from direct sunlight, heat, and humidity;
For longer-term storage, refrigeration at 2–8°C / 36–46°F is recommended unless your product documentation specifies otherwise;
Keep vials sealed until ready for laboratory use.
FlexTide is not responsible for product degradation caused by customer failure to follow storage instructions or by delayed retrieval of delivered packages.
9. Returns, Refunds, and Cancellations
Due to the nature of research materials and the importance of chain-of-custody integrity, all sales are final once an order has shipped. FlexTide does not accept returns or exchanges of research products under any circumstances.
Cancellations may be requested before payment verification or before shipment has occurred. Cancellation is not guaranteed once order processing has begun, and FlexTide will make reasonable efforts to accommodate cancellation requests on a case-by-case basis.
Damaged, Incorrect, or Missing Items
If an item arrives damaged, incorrect, or missing, you must contact FlexTide within 48 hours of delivery confirmation at support@4flextide.com, providing:
Your order number;
Photographs of the outer packaging;
Photographs of the product(s) received; and
A written description of the issue.
Claims submitted outside the 48-hour window, or without the required documentation, may not be eligible for resolution. FlexTide's sole obligation upon a verified valid claim shall be, at our discretion, to replace the affected item or issue a store credit. In no event will FlexTide be obligated to issue a cash refund on a shipped order.
10. Product Information / Certificates of Analysis / Testing
Product descriptions, labels, lot information, purity statements, certificates of analysis, and related documentation are provided for research-reference purposes only. FlexTide makes reasonable efforts to provide accurate and current product information, but does not guarantee that website content is free of typographical errors, complete, or suitable for any specific research application.
Certificates of analysis reflect testing performed on the specific lot identified and do not constitute a warranty of results for any individual vial or research application. FlexTide reserves the right to correct errors or update product information at any time without prior notice.
11. No Resale / No Repackaging
Products may not be repackaged, relabeled, resold, redistributed, or represented as medications, supplements, cosmetics, treatments, or consumer-use products. Any permitted resale or redistribution for lawful research purposes requires the prior express written authorization of FlexTide — which, for purposes of this provision, means a signed written agreement or a written confirmation from a FlexTide authorized representative via official FlexTide correspondence (email from a verified FlexTide domain is sufficient) — and must be in full compliance with all applicable federal, state, and local laws.
12. Export Control Compliance
You are solely responsible for compliance with all applicable export control laws and regulations, including but not limited to the U.S. Export Administration Regulations (EAR) and any relevant international trade restrictions. By placing an order, you represent that you are not located in, or purchasing on behalf of any person or entity located in, a country subject to U.S. trade embargo or sanctions, and that you are not listed on any U.S. government restricted-party list. FlexTide bears no responsibility for the customer's failure to comply with applicable export control laws.
13. Disclaimer of Warranties
ALL PRODUCTS ARE SOLD "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLEXTIDE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
Any implied warranty of merchantability;
Any implied warranty of fitness for a particular purpose;
Any warranty of non-infringement; and
Any warranty arising from course of dealing, usage, or trade practice.
No statement made on this website, in product documentation, or by any FlexTide representative shall create any warranty not expressly set forth in these Terms.
14. Limitation of Liability
To the fullest extent permitted by applicable law, FlexTide shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages of any kind, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or personal injury, arising from or related to the purchase, handling, storage, misuse, or unauthorized use of any product, regardless of whether FlexTide has been advised of the possibility of such damages and regardless of the theory of liability (contract, tort, strict liability, or otherwise).
In any event, FlexTide's total cumulative liability to you for any and all claims arising out of or related to any single order shall not exceed the total amount actually paid by you to FlexTide for the specific product(s) giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you to the extent prohibited by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless FlexTide, its owners, officers, directors, affiliates, employees, contractors, agents, and service providers from and against any and all claims, demands, lawsuits, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
Your purchase, possession, handling, use, misuse, storage, or disposal of any product;
Your resale, redistribution, or unauthorized transfer of any product;
Your breach of these Terms or any applicable law or regulation; or
Your inaccurate or incomplete representations made in connection with placing an order.
FlexTide reserves the right to assume exclusive control of the defense of any matter otherwise subject to indemnification by you, at your expense, and you agree to cooperate with FlexTide's defense of such claims.
16. Dispute Resolution / Binding Arbitration
Informal Resolution First. Before initiating any formal dispute proceeding, you agree to contact FlexTide in writing at 4support@flextide.com and provide a brief description of the dispute and your desired resolution. FlexTide will attempt to resolve the dispute informally within 30 days of receiving written notice.
Binding Arbitration. If the dispute is not resolved informally within 30 days, you and FlexTide agree that any remaining dispute, claim, or controversy arising out of or relating to these Terms, the products, or any transaction with FlexTide shall be resolved exclusively by binding individual arbitration administered by a recognized arbitration body under its applicable commercial arbitration rules. The arbitration shall take place in Missouri, or remotely if mutually agreed.
Class Action Waiver. YOU AND FLEXTIDE EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought in the parties' individual capacity only.
Exceptions. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
17. Accuracy of Customer Information
You are solely responsible for providing accurate, current, and complete billing, contact, and shipping information at the time of order. FlexTide is not responsible for delays, failed deliveries, undeliverable packages, or losses caused by incorrect or incomplete customer-provided information. Re-shipment of orders returned due to address errors may require payment of additional shipping charges.
18. Privacy
FlexTide collects and handles customer information in accordance with our Privacy Policy, which is incorporated herein by reference and available at our Privacy Policy page. By using this website and placing orders, you consent to the collection and use of your information as described in the Privacy Policy.
19. Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, without affecting the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference herein, constitute the entire agreement between you and FlexTide with respect to the subject matter hereof, and supersede all prior and contemporaneous communications, representations, understandings, and agreements, whether written or oral, between you and FlexTide relating to that subject matter. No oral representation or statement made by any FlexTide representative shall be deemed to modify or supplement these Terms.
21. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict-of-law principles. To the extent any court proceeding is permitted under these Terms (including proceedings to enforce an arbitration award), you consent to the exclusive jurisdiction and venue of the state and federal courts located in Missouri.
